Welcome to Linyr360 ("the Platform"). Linyr360 operates as a technology service provider connecting independent transportation operators ("Drivers") with users seeking transportation services ("Riders"). Your data privacy is an absolute priority for us. This policy outlines how we collect, use, process, share, and protect your personal data in strict compliance with the Jamaica Data Protection Act (JDPA), 2020.
1. The Data We Collect
We process information across three distinct domains to safely deliver, maintain, and optimize our ride-hailing infrastructure.
A. Data Provided Voluntarily
- Riders: Full name, email address, mobile phone number, profile photograph, and payment identification markers (such as encrypted credit/debit card tokens).
- Drivers: Full name, contact information, National Identification card details (NIDS, Passport, or National Electoral ID), Tax Registration Number (TRN), and the complete professional transport validation documentation mandated by local regulations:
- Valid Jamaican Driver's License
- Police Record Certificate (Certificate of Good Conduct)
- Transport Authority Taxi Badge
- Hackney Carriage or Contract Carriage Road License
- Certificate of Vehicle Registration
- Certificate of Vehicle Fitness
- All Users: Emergency contact profiles and communications logs generated when interacting with our support desks.
B. Data Collected Automatically
- Precise Geolocation Data: We track Rider and Driver movements via device GPS sensors. For Drivers, background tracking operates continuously whenever the app is toggled active. For Riders, tracking begins at the point of a ride request and runs until verified trip completion.
- Transaction Metrics: Order IDs, precise timestamps of service, total distance traveled, and exact monetary fare breakdowns.
- Device Metrics: IP addresses, hardware manufacturer, operating system version, software application crash logs, and unique mobile device identifiers.
C. Data from Third Parties
- Official background check updates and regulatory credential validations received directly from the Transport Authority of Jamaica or local law enforcement agencies.
2. Legal Basis and Purpose of Processing
In accordance with the JDPA, Linyr360 establishes the following legal pillars to handle your personal data:
- Performance of a Contract: Necessary to seamlessly link Riders with Drivers, process fare clearances, facilitate transport, and manage active user accounts.
- Legitimate Business Interests: Executed to detect fraudulent billing, prevent security breaches, optimize real-time transit routing, and preserve platform safety.
- Legal Obligation: Required to fulfill statutory mandates and disclosure requests from the Transport Authority of Jamaica, the Island Traffic Authority, or law enforcement directives.
- Consent: Collected for voluntary marketing communications. Our website sets no tracking cookies and runs no page analytics or trackers. Our apps contain no advertising SDKs.
3. Data Sharing and Disclosures
Linyr360 does not sell personal data. Your information is shared strictly under these transparent conditions:
- Between Riders and Drivers: Drivers receive the Rider's first name, pickup coordinates, and final destination. Riders receive the Driver's name, photo, vehicle make/model, license plate number, taxi badge details, and live GPS location map.
- Payment Gateways: Financial transaction data is encrypted and securely routed via the Powertranz gateway to process payouts and charges through our National Commercial Bank (NCB) merchant account.
- Regulatory and Legal Authorities: Data is disclosed to Jamaican law enforcement or the Transport Authority upon production of a valid judicial subpoena, court order, or formal statutory mandate.
- Service Providers: Third-party cloud storage and analytical systems bound by comprehensive data processing agreements.
4. International Data Transfers
Your data may be hosted on cloud infrastructure situated outside the territory of Jamaica (such as the United States or Europe). In strict alignment with the JDPA, Linyr360 ensures that international transfer systems utilize standard contractual clauses and rigorous security validations to guarantee an adequate level of data protection matching local legal baselines.
5. Data Retention and Security
- Retention Policy: Active account data is preserved for the lifecycle of your profile. Upon account deletion, specific data is archived or pseudonymized. Statutory requirements under Jamaican law dictate that transactional records, tax logs (TRN), and driver compliance certificates are securely archived for up to 7 years before permanent destruction.
- Security Framework: We enforce technical safeguards including AES-256 encryption at rest, TLS/HTTPS encryption in transit, multi-factor workforce authentication, and isolated server environments.
6. Your Rights Under the JDPA
As a data subject in Jamaica, you possess the following statutory rights, enforceable by contacting our Data Protection Officer:
- Right of Access: Obtain a full digital copy of all personal records we store concerning you.
- Right to Rectification: Mandate immediate corrections to inaccurate or incomplete personal datasets.
- Right to Erasure ("Right to be Forgotten"): Request permanent data deletion when processing reasons expire.
- Right to Restrict Processing: Limit how your personal parameters are utilized under distinct operational challenges.
- Right to Object: Object directly to automated processing algorithms, profiling mechanisms, or promotional marketing.
- Right to File a Complaint: File formal grievances directly with the Office of the Information Commissioner (OIC) of Jamaica.
7. Automated Decision-Making
Linyr360 utilizes automated algorithms for localized route optimization, Estimated Times of Arrival (ETAs), dynamic surge pricing patterns, and fraudulent account detection. Users hold a right to demand a manual administrative review if any automated algorithm triggers an account suspension or contract termination.
Pre-launch waitlist
Before Linyr360 launches in your area you can ask us to notify you, or register your interest in driving. We collect only what you type into the form: your first name (optional), a phone number or email address, the area you are in, and — for drivers — whether you already hold a PPV badge. We record the version of this policy shown to you and a one-way hash of your connection's IP address to prevent abuse.
We use this information for one purpose: to tell you when Linyr360 launches or when driver onboarding opens in your area. The lawful basis is your consent, given when you submit the form. We do not add you to marketing lists, share your details with anyone, or contact you for any other reason.
We keep waitlist entries for twelve months after launch in your area, then delete them. To be removed earlier, email support@linyr360.com from the address you registered, or text "STOP" from the number you registered.
8. Changes to This Privacy Policy
We reserve the right to modify this document to adjust to operational shifts or changing regulatory criteria across Jamaica. Material modifications will be flagged directly inside the application interface or sent via email prior to implementation.
